AukCliff Limited Terms of Service

Welcome to AukCliff! We're thrilled you've chosen us to outfit you for your next adventure.

These Terms of Service ("Terms") govern your use of our website and services. By placing an order or accessing any part of our site, you agree to these Terms. Please read them carefully.

1. Governing Law

These Terms and any disputes arising from them are governed by the laws of New Zealand. If you're based outside of New Zealand, this choice of law does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

2. Limited Warranty

AukCliff offers a 30-day Limited Warranty on all products for manufacturing defects or material flaws.

This warranty does not cover:

  • Normal wear and tear
  • Misuse, improper care, or accidents
  • Modified or altered products

To submit a claim, contact us at customerservice@aukcliff.com within 30 days of receiving your product. Include a description of the issue and a copy of your receipt. Shipping costs may apply.

3. Taxes

You're responsible for paying any applicable local taxes, duties, or import charges unless we've informed you otherwise.

4. Order Changes & Cancellations

Once an order is confirmed, changes or cancellations may not be possible. If you have an urgent issue, reach out to customerservice@aukcliff.com and we’ll do our best to assist you.

5. Delivery & Ownership

Once an order is handed to the carrier, it becomes your responsibility. You or your customer must file any claims for lost shipments with the carrier. Ownership passes to you upon dispatch.

If your parcel is lost, notify us within 30 days of the estimated delivery date. Claims will be assessed case-by-case.

6. Product Information

We aim to accurately display our products, but variations in screen settings or manufacturing may result in slight differences. Small imperfections that don’t affect performance may occur.

Out-of-stock items may be replaced with a similar product. We will notify you when possible. You can opt out of substitutions by contacting our customer service team.

7. Returns & Refunds

  • Misprint, Damage, or Defect: Report any issues within 30 days by emailing customerservice@aukcliff.com. Include a photo and your order details. We’ll review your claim within 1–2 business days and, if approved, will issue either a refund or a free replacement. No return is required for defective items.

  • Incorrect Size Orders: You must notify us by email at customerservice@aukcliff.com within 10 days of receiving your item. Returns must be unworn, unwashed, and in original packaging. You’ll be responsible for return shipping and will receive store credit once we receive the item or tracking number so that you can place a new order for the correct size your required.

  • Change of Mind: We do not accept returns due to buyer’s remorse.

8. SMS Marketing

By providing your mobile number, you agree to receive marketing and order-related messages from us. Message & data rates may apply. To opt out, text “STOP.”

9. Intellectual Property

All content, designs, logos, slogans, and graphics on our site and products are © AukCliff Limited 2024. You may not reproduce or distribute any materials without written permission.

10. Disclaimers & Limitations

We are not liable for any indirect or consequential loss. Some jurisdictions do not allow limitations of liability, so some exclusions may not apply.

11. Indemnity

You agree to indemnify and hold AukCliff harmless from any claims, liabilities, damages, or legal costs arising from your use of our services or your breach of these Terms.

12. Dispute Resolution

We aim to resolve issues amicably. If necessary, legal proceedings must be brought in New Zealand courts.

13. Force Majeure

We are not liable for delays or failures caused by events beyond our control (e.g., natural disasters, pandemics).

14. Entire Agreement

These Terms, along with our Privacy Policy and any other provided agreements, constitute the entire agreement between you and AukCliff.
